South Dakota: Market and legal data for the cannabis sector

4th June 2024: US - South Dakota: The Secretary of State has verified enough signatures for a ballot measure that would legalise recreational cannabis in the state to reach the November ballot, press reports. The same advocates behind this measure put initiatives on the ballot twice before, once in 2020 – which was approved by voters but later overturned by the courts – and again in 2022, when voters rejected it. If approved, the measure would allow for the possession, use and transportation of cannabis by adults (21+), and allow adults to cultivate up to six plants in their homes.
9th May 2024: US - South Dakota: Advocates have turned in more than 29,000 signatures to place an initiative on the November 2024 ballot to legalise recreational cannabis, press reports. The secretary of state must now verify that there are at least 17,508 valid signatures for it to reach the ballot. The same advocates put initiatives on the ballot twice before, once in 2020 – which was approved by voters but later overturned by the courts – and again in 2022, when voters rejected it. Advocates hope that higher voter turnout in a presidential election year could lead to results more similar to 2020 than 2022.
27th March 2024: US - South Dakota: House Bill (HB) 1125 has been signed by the governor. HB 1125 will prohibit "chemically derived cannabinoids" – which are psychoactive cannabinoids that are changed molecularly through a chemical process (not to include decarboxylation) – from being produced or sold in the state. It will be unlawful to chemically modify or convert industrial hemp, or engage in any process that converts cannabidiol, into delta-8 THC, delta-9 THC, delta-10 THC, or any other tetrahydrocannabinol isomer, analogue, or derivative.
20th March 2024: US - South Dakota: Senate Bill (SB) 43 has been signed by the governor. SB 43 will make minor amendments to the state’s medical cannabis programme by requiring the Department of Health to establish certain penalties for violation of medical cannabis regulation and increasing the maximum amount that the department can charge for registration certificates.
8th March 2024: US - South Dakota: Senate Bill (SB) 117 has been signed by the governor. SB 117 will exclude “industrial hemp stalk bale” from certain requirements and extend the validity of a hemp processor licence to three years.
7th March 2024: US - South Dakota: Senate Bill (SB) 42 has been signed by the governor. SB 42 will make various amendments to the state’s medical cannabis programme, including changes to testing requirements, the allowable amount of medical cannabis that can be dispensed to qualified patients, and the procedure for violations of medical cannabis regulations.
27th February 2024: US - South Dakota: Senate Bill (SB) 117 has been passed by both chambers (the Senate and the House) and now heads to the governor. SB 117 would exclude “industrial hemp stalk bale” from certain requirements and extend the validity of a hemp processor licence to three years.
27th February 2024: US - South Dakota: House Bill (HB) 1125 has been passed by the Senate. As the Senate amended the previously passed House version, the bill must be reconciled before being sent to the governor. HB 1125 would prohibit “chemically derived cannabinoids” – which are psychoactive cannabinoids that are changed molecularly through a chemical process (not including decarboxylation) – from being produced or sold in the state. The Senate has amended the bill to include that it would be unlawful to chemically modify or convert industrial hemp, or engage in any process that converts cannabidiol into delta-8 THC, delta-9 THC, delta-10 THC or any other THC isomer, analogue or derivative.

SB42 would make various amendments to the state’s medical cannabis programme. Amendments include changes to testing requirements, the allowable amount of medical cannabis that can be dispensed to qualified patients, and the procedure for violations of the medical cannabis regulations.

HB 1125 would prohibit "chemically derived cannabinoids", which are cannabinoids that are changed molecularly through a chemical process (not to include decarboxylation), from being produced or sold in the state.

SB 43 would make minor amendments to the state's medical cannabis programme by requiring the Department of Health to establish certain penalties for violations of medical cannabis regulations and increasing the maximum amount that the department may charge for registration certificates.
