Utah: Market and regulatory data analysis of the cannabis sector

18th September 2024: US - Utah: The Utah Department of Agriculture and Food has proposed a rule that would prohibit “artificially derived cannabinoids”, which would specifically include HHC. It would define an “artificially derived cannabinoid” as “a chemical substance that is created by a chemical reaction that changes the molecular structure of any chemical substance derived from the cannabis plant” but would exclude cannabinoids extracted from the plant or those created via decarboxylation. The proposed rule is under public comment until 15th October.
14th March 2024: US - Utah: House Bill (52) – which will modify and enact provisions related to industrial hemp – has been signed by the governor. HB 52 will further modify provisions to allow the transportation of industrial hemp concentrate under certain circumstances. It will be unlawful to sell, offer to sell, or distribute a cannabinoid product in the state without obtaining a licence.
4th March 2024: US - Utah: Senate Bill 233 has been passed by the House and now heads to the governor's desk. The bill would allow the delivery of medical cannabis to more address types and modify provisions related to cannabis production facility applications. The bill would also modify reporting requirements and require pharmacy licences to be renewed and awarded under the licensing board. It would further modify identification requirements related to obtaining medical cannabis from a medical cannabis pharmacy.
1st March 2024: US - Utah: House Bill (HB) 389 has been passed by the Senate and now heads to the governor’s desk. The bill would prohibit a person or entity from owning more than 30% of the state’s licensed medical cannabis dispensaries and would allow “closed-door medical cannabis pharmacies”, which are defined as “a facility operated by a home delivery medical cannabis pharmacy for delivering cannabis or a medical cannabis product”.
29th February 2024: US - Utah: House Bill (HB) 52 has been passed by the Senate and now heads to the governor’s office. HB 52 would modify and enact provisions related to industrial hemp and would further modify provisions to allow the transportation of transportable industrial hemp concentrate under certain circumstances. It would be unlawful to sell, offer to sell, or distribute a cannabinoid product in the state without first obtaining a licence.
27th February 2024: US - Utah: Senate Bill (SB) 71 has been passed by the Senate and now heads to the House for consideration. SB 71 would enact a non-refundable income tax credit for business expenses related to cultivating, processing or selling medical cannabis within the state.
23rd February 2024: US - Utah: Senate Bill (SB) 233 has been passed by the Senate and now heads to the House. SB 233 would allow the delivery of medical cannabis to more address types and modify provisions related to cannabis production facility applications. The bill would also modify a reporting requirement and require pharmacy licences to be renewed and awarded by the licensing board. It would further modify identification requirements related to obtaining medical cannabis from a medical cannabis pharmacy.
16th February 2024: US - Utah: House Bill (HB) 389 has been passed by the House and now heads to the Senate. The bill would prohibit an individual or entity from owning more than 30% of the state’s licensed medical cannabis dispensaries and would allow “closed-door medical cannabis pharmacies”, which are defined as “a facility operated by a home delivery medical cannabis pharmacy for delivering cannabis or a medical cannabis product”.
2nd November 2023: US - Utah: The Utah Department of Agriculture and Food has issued proposed rules to regulate home delivery of medical cannabis. The proposed rules are under a comment period until 1st December 2023.
17th March 2023: US - Utah: Senate Bill (SB) 137 has been signed into law by the governor. SB 137 modifies the state's medical cannabis laws in several ways, including requiring terpene testing and disclosure of terpene profiles for certain products and extending the expiry date of initial issuances of medical cannabis cards from six months to one year, unless the practitioner recommends a shorter period.
17th March 2023: US - Utah: House Bill (HB) 72 has been signed into law by the governor. HB 72 makes various amendments to the state's medical cannabis programme, such as allowing for delivery of medical cannabis products directly from licensed processors under certain conditions and shifting regulation of pharmacies to the Department of Agriculture and Food. The bill also creates a Medical Cannabis Policy Advisory Board.
17th March 2023: US - Utah: Senate Bill (SB) 91, has been signed into law by the governor. SB 91 changes the state’s medical cannabis laws in various ways, including removing a cap on the number of licences for testing laboratories, modifying and adding labelling requirements, and requiring heavy metal testing for vape cartridges.
